Perle Genetiq services are provided virtually through the Perle Genetiq electronic health record (EHR) (powered by Colib) to provide professional genetic counseling consultations, family history analysis, risk interpretation and personalized healthcare education.
Summary
By using Perle Genetiq services, you understand that your information will be treated in accordance with this Perle Genetiq Services Commitment (“Privacy Commitment”). Our Privacy Commitment and practices are consistent with the 10 Fair Information Principles, and we strive to apply the principles of Privacy by Design in the development and review of our products and services.
If you do not want us to collect, use, or disclose your Personal Information or Personal Health Information in the ways identified in this Privacy Commitment, you may choose not to use Perle Genetiq services.
We have developed this Privacy Commitment to provide you with specific details about how Perle Genetiq Services collects, uses, discloses and stores your Personal Information, which includes your Personal Health Information, when you use the Colib EHR (accessible at https://www.colib.io/Booking/perlegenetiq), or otherwise interact with us.
The Privacy Commitment reflects the requirements of applicable Canadian and Quebec privacy legislation, including provincial and federal privacy laws (such as Quebec’s Law 25), and our own continuing commitment to privacy.
Please read this Privacy Commitment carefully. By accessing or using Perle Genetiq services you consent to the collection, use, disclosure and storage of Personal Information in accordance with this Privacy Commitment.
1. Definitions
- You: An individual who uses, or registers to use, and access Perle Genetiq services.
- Medical Record: A record of your Personal Health Information (PHI), including identification, electronic consents, records of online communication, summary letters, consultation notes, and records of missed or cancelled appointments. This record may also include pertinent healthcare information collected from third-party sources outside of Perle Genetiq, such as previous medical exams, consultations, or genetic testing results provided by you, other healthcare practitioners or laboratories.
- Personal Health Information (PHI): Any Personal Information regulated under applicable health privacy legislation in the provinces and territories in which we operate, including information that relates to an individual’s physical or mental health and healthcare including health history, the provision of healthcare to the individual, payments or eligibility for healthcare, healthcare provider, substitute decision-maker, health card number or other healthcare-related personal identification numbers, or any other information that is collected in the course of providing health services to the individual, including information contained in your Medical Record.
- Personal Information (PI): Any information about an identifiable individual, other than business contact information used to contact the individual in their business or professional capacity. Personal Information includes your Colib EHR account profile and Personal Health Information. Personal Information does not include de-identified or aggregated information that cannot reasonably be associated with a specific individual.
- Perle Genetiq: In this Privacy Commitment, the words “we”, “us” or “our” refer to Perle Genetique S.E.N.C.
- Genetic Counsellors: Board-certified allied health professionals who provide or assist in the provision of genetic counseling services, including risk interpretation, clinical education, and the facilitation of genetic testing and clinical assessments in collaboration with internal or external authorized medical providers (such as Physicians or Nurse Practitioners).
- Perle Genetiq staff: May include office assistants, genetics administrative coordinators, genetic counsellors, and genetics program managers who may perform administrative tasks related to your account.
2. Consent
When you use Perle Genetiq services, you consent to our collection, use, disclosure, and storage of your Personal Information in accordance with this Privacy Commitment. Use of Perle Genetiq services does not require you to proceed with genetic testing. Prior to initiating genetic testing or related clinical activities, informed consent for the specific service you are interested in will be obtained.
You can withdraw your consent to the collection, use and disclosure of your Personal Information at any time, subject to our legal or contractual restrictions. However, if you refuse to provide certain information or withdraw your consent, this may limit our ability to provide you with genetics services, products, and functionalities.
If you want to delete your account, we may retain certain information to meet our legal or regulatory obligations; for example, Personal Information that forms part of your Medical Record must be retained for a prescribed period of time. Please review the ‘Retention’ section below for more information on our retention practices. To collect, use or disclose Personal Information outside of the purposes contemplated in this Privacy Commitment, we will seek additional consent from you. Individuals under the age of majority in their jurisdiction of residence are not eligible for Perle Genetiq services without the involvement and consent of a parent or legal guardian.
3. Collection and Use of Personal Information
We collect only the Personal Information required to establish and maintain a responsible healthcare relationship, provide our services, and improve our offerings.
- Account Creation: To use the platform, you must provide your name, sex at birth, date of birth, address, email, and phone number through the Colib system.
- Genetics Services: You will need to provide information about your current health condition and personal and family health history to enable our Genetic Counsellors to provide accurate risk interpretations. This information is collected through questionnaires delivered via the Colib system and during consultations conducted via phone or secure virtual video sessions.
- Service Messages: We may contact you by email to provide you with helpful information related to our services such as an alert that you have an unread message or results are available. You can request to deactivate your account at any time by contacting info@perlegenetiq.ca.
- Product Development and Marketing: We use Personal Information to develop, enhance, or market our products and services (including to send you relevant information about products and services that may be of interest to you) related to the Perle Genetiq program. With your permission, your contact details, including your name and email address, may be used so that Perle Genetiq can provide you with genetics-related news and offers. These communications will not use information contained in your Medical Record. You can opt out of receiving newsletters and marketing messages from us at any time by following the unsubscribe instructions included in each of our marketing messages or by contacting us at info@perlegenetiq.ca.
- Research Purposes: We may collect and use information for research purposes in collaboration with university research groups. In accordance with applicable laws, including Quebec’s Law 25, we primarily use de-identified information for these purposes—this means information that does not directly identify you, though a risk of re-identification may remain. If identifiable information is required for a specific research project, we will obtain your explicit, informed consent prior to use or disclosure. We may share aggregated, de-identified insights with our clients and partners. In rare instances where information is fully anonymized (meaning it is irreversibly stripped of all identifying traits), it may be used for broader statistical purposes without further notice.
- Payments: Appointments are booked and paid for through Colib. Our third-party service provider will collect payment information, including billing address and payment card details, to facilitate secure processing.
- Technical Data: We collect IP addresses and device types to ensure a secure experience and monitor the functionality of our website and the Colib system.
- Technical Support: In certain circumstances, Personal Information may be required by or accessible to technical support staff in order to resolve technical issues. Where possible, our support team will resolve issues without viewing Personal Information.
- Satisfaction and experience surveys and questionnaires: Your contact details, including your name and email address may be used by us to contact you regarding your experience with Perle Genetiq Services. All feedback you share will remain anonymous. Results of genetic testing will not be shared.
4. Cookies and Tracking Technologies
We use cookies and similar tracking technologies on our website and through the Colib EHR to enhance your experience, ensure security, and analyze how our services are used.
- Strictly Necessary Cookies: These are essential for the operation of our website and EHR (e.g., to enable you to log in to secure areas or process payments).
- Functional and Analytical Cookies: With your consent, we may use cookies to remember your preferences or to collect de-identified data on website traffic to improve our services.
- Consent and Control: By default, non-essential tracking technologies are deactivated on our website. You can manage your preferences through our cookie consent banner or by adjusting your browser settings.
5. Sharing and Disclosure
We will not disclose your Personal Information for any purpose other than what is outlined here or permitted by applicable law without your express consent. We do not sell your Personal Information to any third parties.
- Healthcare Providers: Information will be shared with your family doctor, hospital, or specialist only with your consent (unless we are required to do so under applicable laws). This includes sharing information with internal or external authorized providers (MDs/NPs) and diagnostic laboratories when facilitating clinical grade genetic testing and related clinical assessments. We may also disclose your Personal Information to third parties such as other laboratories or counselors external to Perle Genetiq for the purpose of providing or assisting in the provision of healthcare to you – this includes, but is not limited to, providing medically appropriate referrals or lab requisitions.
- Research Partners: We may disclose information to university research groups for approved research projects. Any such disclosure will be subject to strict confidentiality agreements and, where required by law or ethics, specific participant consent.
- Service Providers: We may share PI with contracted organizations, such as our platform provider Colib, who assist us in serving you. We ensure these providers protect your information with the same level of care as we do. For example, we may use service providers to process payments, host our website, provide text-based technical support, and store and dispose of information on our behalf. We strive to minimize the amount of Personal Information that we share with our service providers and partners and require that it not be used for any other purpose.
- Third-Party Links: Our services may contain links to external websites or platforms not operated by Perle Genetiq. These links are provided for convenience and do not imply endorsement. Linked sites have independent privacy policies and terms; we do not control and are not responsible for how these third parties handle your Personal Information.
- Legal Requirements: We may disclose Personal Information to the extent necessary where we are required or permitted under applicable law, such as in the event of an emergency that threatens the life, health or security of an individual. We or our service providers will also share Personal Information with law enforcement, courts, other government agencies or other parties if we are required to do so to meet our legal and regulatory requirements in the jurisdictions in which we or our service providers operate; for example, we are required to provide records to law enforcement in response to a valid court order.
6. Storage, Location, and Retention
- Storage: Our third-party service provider (Colib) utilizes administrative, physical, and technical safeguards to ensure your Medical Record is encrypted in transit and at rest.
- Location: Your Personal Information and Medical Records are stored on secure servers located within Canada. As we are headquartered in Quebec, please be advised that your information may be communicated or stored outside of Quebec (but within Canada). We conduct Privacy Impact Assessments to ensure that any information transferred outside of the province receives adequate protection in accordance with Quebec’s Law 25.
- Retention: We retain Personal Information only for as long as necessary to fulfill healthcare purposes or legal requirements. For Medical Records, we follow a retention of 16 years from the date of the last entry or from the age of 19, whichever is later.
7. Access and Corrections
You may request access to or correction of the Personal Information we hold about you at any time by contacting us at info@perlegenetiq.ca. We rely on you to ensure your information is accurate, complete, and up-to-date. Under Law 25, you also have the right to data portability (receiving a copy of your structured personal information) and the right to request the cessation of dissemination of your information in certain circumstances. We will respond to your request within thirty (30) days.
8. Safeguards
We utilize a comprehensive information security program through our service provider, which includes administrative, technical, and physical safeguards designed to protect against unauthorized access, use, or loss of Personal Information. While we rely on our service provider’s infrastructure, we have performed due diligence to ensure they meet Canadian and Quebec regulatory standards.
In the event of a “Confidentiality Incident” (data breach) identified by us or our service provider, we will fulfill our legal obligations to notify the appropriate regulatory authorities and affected individuals as required by Law 25 and applicable provincial health privacy laws.
Please keep in mind that no internet or email transmission is ever fully secure or error free and no security system is impenetrable. We cannot fully guarantee the confidentiality of any information that you provide to us but we can assure you that we will use reasonable and appropriate security controls, reflective of the sensitive nature of Personal Health Information.
It is important for you to play an active role in the protection and safeguarding of your Personal Information. It’s important to guard your privacy when you are online. If the Perle Genetiq website contains links to other websites, this Privacy Commitment does not govern those websites. You should read their privacy policies and make an informed decision about whether you want to use those websites or their services.
9. Changes to this Privacy Commitment
This Privacy Commitment may be updated from time to time to reflect changes to our practices or legal obligations. Any notices regarding modifications to this Privacy Commitment will be provided to you on the Perle Genetiq website.
If any changes to this Privacy Commitment are significant, we will provide a more prominent notice (including email notification, where appropriate). We encourage you to periodically review our Privacy Commitment for the latest information on our privacy practices and to contact us if you have any questions or concerns.
